So after they signed the new budget deal, President Joe Biden's Department of Justice unveiled a brand new entity that will train state and local officials on procedures to apply red flag laws to confiscate firearms from

gun owners who are a threat to themselves or to others.

Now, I want you to understand this is not something that has passed through Congress.

These red flag laws have been going up for states and the federal government has been offering people help and advice and lots of money if they will join.

So the Department of Justice announced on Saturday the creation of the National Extreme Risk Protection Order Resource Center.

That's going to be hard to get that whole thing over the door of the building.

I'm just saying it's not real catchy.

The National Extreme Risk Protection Order Resource Center.

The entity is just going to be called the Center.

The National Extreme Risk Protection Order Resource Center will provide training and technical assistance to law enforcement officials, prosecutors, attorneys, judges, clinicians, victim services, social service providers, community organizations, behavioral health professionals responsible for implementing laws designed to keep guns out of the hands of people who pose a threat to themselves or others.

That's all from the website.

That's what they do.

They're just going to provide training, technical assistance, and money.

What was that last one?

And behavioral health professionals responsible for implementing laws designed to keep guns out of the hands of people who pose a threat to themselves or others.

So these are laws, not simple guidelines.

These are laws, and they are being implemented by behavioral health professionals who are responsible for those laws.

Oh,

I don't remember.

Stu, who did you vote for on your behavioral health professionals that are responsible for these laws?

Which one did you vote for?

You know, I don't remember.

There were so many good candidates this year.

I know.

We had more candidates, and yet we ended up with these losers.

The DOJ said in a statement: the ERPO laws, which are

modeled off domestic violence protection orders, create a civil process allowing law enforcement, family members in most states, and medical professionals or other groups in some states to petition a court to temporarily prohibit someone from harming themselves or others from purchasing or possessing firearms for the duration of the order.

Now, the National Extreme Risk Protection Order Resource Center's website declares that it will provide training and technical assistance, such as the development and

dissemination of training for ERPO stakeholders.

Stu, are you a stakeholder in this law?

Because

they didn't consult me or my representative.

My understanding is you do not need to be consulted to be a stakeholder.

You sort of

spend that life.

Yeah.

Yeah, okay, because your representative is supposed to represent you.

This is the way stakeholder, we're not making this up.

This is the way the stakeholder system works.

You have your vote.

That's it.

You have your vote.

Now, you voted for a representative.

And sorry, but this one didn't even go through Congress, so you know.

This just went through the Department of Justice.

Okay, so the development and dissemination of trainings for ERPO stakeholders, support for states and local

jurisdictions to implement ERPO programs, facilitation of peer-to-peer engagement with model ERPO learning sites.

Delivery of presentations and webinars to advance states and localities' knowledge on key ERPO topics.

Now, the red flag laws allow the government

to confiscate firearms from legal gun owners without due process.

Wait a minute.

Hang on just a second.

I just saw something up here.

ERPO laws, which are modeled after domestic,

create a civil process allowing law enforcement, family members, and medical professionals in the states to petition a court to temporarily prohibit someone risking harm to themselves.

So wouldn't that

be...

Because I gotta go to court.

I guess they're not modeling after that, right?

I don't even get to face my accuser.

Oh,

that's an interesting piece of democracy I don't recall ever seeing before.

So I don't get to go to court.

My accuser and the ERPO people are just going to come to my house and take my gun because somebody has said I am a danger to myself or to the community and I have no due process.

Huh, that's interesting.

The DOJ press release said 21 states and the District of Columbia, shockingly, have enacted ERPO laws.

The White House noted that only six of the states that implemented ERPO laws have utilized federal funds from the bipartisan Safer Communities Act, which offers $750 million for red plat-frat flag programs.

Medical health courts, love those medical health courts, drug courts, and even veteran treatment courts.

Veteran treatment courts.

Man, do you remember when the government was pushing that you would get out and you'd get more money from the VA?

You'd get special treatment from the VA if you would just say that you had some

PSTD?

Is that it?

PTSD.

Remember that?

If you claimed PTSD, you'd get extra benefits.

So a lot of guys were like, yeah, I'm going to do that.

And I remember saying on the air, don't do that.

because now you're marking yourself as unstable.

And if you're unstable, all the government has to do is say anybody who you know claim to have PTSD, well, gosh darn it, they can't have their guns because they might harm themselves or others.

Oh my gosh.

Now the National Extreme Risk Protection Order Resource Center is a collaboration.

It is a public-private partnership between Johns Hopkins Center for Gun Violent Solutions and the U.S.

Department of Justice and the Bureau of Justice Assistance.

I don't even know what justice assistance is, but I'm sure that, you know, it's all great and full of great people.

The Attorney General told us over the weekend the launch of the National Extreme Risk Protection Order Resource Center will provide our partners across the country with valuable resources to keep firearms out of

the hands of individuals who pose a threat to themselves and others.

The establishment of the center is the latest example of the Justice Department's work to use every tool provided by the landmark bipartisan

Safer Communities Act to protect communities from gun violence.

Now, I don't know about you, but

when that Safer Communities Act was passed, I remember a lot of talk about, hey, that's going to lead to a giant new organization that is going to be working with a hospital.

By the way, the very first German progressive hospital.

It's John Hopkins that started it all, kids.

So they're working with John Hopkins to define

what people should be looking for.

And that way,

they can just take your gun away without any kind of due process.

I think this is good.

I think this is good.

Now, the story does say that conservatives have been bashing the center as a new version of government overreach that attempts to infringe on the Second Amendment rights.

Stu, how could these people think, these conservatives think that

this is government overreach attempting to infringe on the Second Amendment rights?

You know, these conspiracy theorists, this is what they do every time, you know, and you would know.

Wait, what do you mean?

He's the real danger.

He's the puppet master.

David Harsani said defending democracy by stripping Americans of their due process and Second Amendment rights is using unilateral federal decree.

That's what this is.

Timing of this is intentional.

This is an unauthorized attack on our Second Amendment.

Libertarian activist Spike Cohen said this is federal red flag.

Dana Lash said, this won't apply to Hunter Biden, illegal aliens, or cartel members that Dems fight to arm.

This is an attack on due process, ignores existing laws, and provides a way to adjudicate someone ineligible.

All previous tragedies were preventable without removal of due process.

I mean, and the worst part about this, and it's really tough on Trump in that he is,

I think he has a really good chance of getting this overturned or at least minimized when it comes to appeal.

a 0% chance of winning this as it rolls for the court.

I think he's got a really good chance.

And like, I just keep coming back to this idea that we now have this, the Democratic Party, which is running its entire campaign, basically saying, we are the saviors of democracy.

But look at all the things they're doing right now.

They're trying to throw their opponent in prison.

They're trying to get him taken off the ballot.

They're trying to personally bankrupt him.

They are also...

All the things that Vladimir Putin's done.

Go ahead.

They are also.

Trying to get third party candidates removed from the ballot in state after state after state after state.

They are denying Secret Service protection to RFK jr who basically every other family member in you know that he has has been assassinated or at least attempted i think even if you have a good smile or big teeth those people are in danger yeah so you know it's like they kill all the kennedys i don't know he might be a kennedy look at his teeth yeah either i mean either the man needs secret service detail pretty much every kennedy has either been assassinated attempted to be assassinated or has committed some horrific crime against someone else some

are qualified for multiple parts of that group.

With some of the family members, maybe it balances itself out.

Is that what you're saying?

It's a very balanced family if you look at the whole.

You just have to do a lot of averaging to get there.

But then you also go back to the primary where they did everything they can to

change the rules and make it difficult for anyone to challenge him in a primary.

And he wouldn't even debate his primary opponents.

I mean, how is this the face of democracy?

They're trying to do everything they can to have a ballot for you that has one name on it.

That is not democracy, and yet that is what they're attempting.

You know, when you were talking about Nerpork

or whatever that agency, you said it had a long name and probably couldn't sit it over the door, so I kind of made an acronym there.

Yeah.

When you were talking about it, I went from entertainment to enlightenment.

A bulb went off in my head, and I thought, oh, my gosh, I'm one of those crazy people that have to take my gun away from me because several years ago, I had tinnitus or whatever, you know, the hearing condition tinnitus

started to develop.

So I went to a couple specialists and, you know, they tested me and this and that.

And I filled out this survey and it was like just the front of one page and it had smiley faces and frowny faces.

And you had the circle.

I feel depressed today.

you know, scale of one to five.

I feel like harming myself or others.

And I remember filling out that survey thinking, this is weird.

Why do they need to know this?

And then fast forward a couple of years ago, I was taking Tylenol a lot for pain, and my doctor said, Oh, I don't want you on that.

I want you on Tramadol, which is a controlled substance.

So now you've got to come see me every quarter.

So I go to the doctor quarterly because I'm on this controlled substance.

And I have to fill out that exact same survey with the smiley faces.

But it's two different offices.

One was a hearing center, and another one is my regular primary care doctor.

And my wife told me a couple weeks ago that she filled out a survey, described it to me, and it was the same dang survey.

And

all of a sudden, I realized, you know, they're collecting this.

If you say, I'm depressed over an event in your life, like your mother died or something, then

if they catch you that week and you say, yeah, I'm depressed, then they can literally say, you can't have a gun.

It's crazy.

Yeah.

Yeah.

And anyone can do it.

And I'm pretty sure you don't get to face your accuser.

You don't know who did it, turned you in as unstable.

And

there's no recourse for you.

Sorry.

There's no due process for you.

This is such

an extreme violation of the Constitution.

And, you know, thank God there is election just a few months away.

But this has got to stop.

This has got to stop.

It's, It's again the public-private partnership that the government's laying out.

That way

they can violate the Constitution because it's a public-private partnership.

They're not government.

They're not government.

That's just Google.

They're fine.

I mean, we talk to them every day.

We tell them exactly what they can and can't do.

And if they disobey us, we then threaten them with all kinds of legal action.

But, you know, they're doing it because they really, really want to.

And the same thing, you know, with this.

We're not, look,

we're just trying to provide a service.

That's all we're doing.

We're just trying to protect the citizens, you know?

And if other citizens think that, you know, you are a threat, well, we should know that.

So we can just, if it would just save one life.

If it would just save one

Now, we don't think that with transgender surgery.

No, no, if it takes a few lives, that's all right.

But we want to make sure that those kids that

really will grow up to want to be transgender, well, that they get that early start.

And if, you know, if a few kids are mutilated or harmed in the way, hey, that's okay.

But on guns, you know, if it would just save one life.

And I think it's ⁇ but then I'm a conspiracy nut, but I think it's interesting that this is coming out

at the same time we're hearing reports of gangs roaming our country gathering in groups of 12 and 15 and just breaking into homes and taking what they want.

And I think it's so interesting these two together.

What do you tie together?

How do you tie those two together?

The Democrats have seemed to have quite an affinity towards lawlessness.

In fact, our vice president even went so far as to bail these rioters out of jail.

we want to protect those young men that are coming into our homes so they don't accidentally get shot by some

errant crazy nut job.

just thinks he's protecting his own stuff.

that's why they have this

their job is to protect the American people.

I don't know, but they are doing things behind our back.

Should we give them the benefit of the doubt on that one?

But they are going behind our back.

And one of the things that they did on Saturday is they opened a really special, special place.

The Department of Justice, who we all trust now, announced the creation of the National Extreme Risk Protection Order Resource Center.

What do they do?

Well, they're just coordinating things, you know, with the states and with public-private partnerships and doctors to come up with new guidelines to make sure dangerous people don't have guns.

And they can come and take your gun away

and

you don't have anything to say about it.

They're just issuing orders.

Some people called in and said that you probably are very, very dangerous, either to yourself or to others.

So we're going to have to take your gun.

And no court appearance.

What they say goes.

I'll tell you that right now.

Let's look at the Constitution and see how many things are being violated.

We'll begin there in 60 seconds.

So, you know, I thought we'd look at the Constitution.

A caller last hour was right on the money.

When he said, you know, this center that can take your

gun away without due process.

Yeah,

that's a big one.

That's a violation of the Second Amendment.

But it's also

a violation of many other amendments.

I want to go through the,

you know, just the first 10 amendments, okay?

First of all, do you know how the Bill of Rights came about?

Listen to what they wrote.

This is at the top of the page.

Resolved.

Resolved by the Senate and the House of Representatives of the United States of America in Congress assembled, two-thirds of both houses concurring that the following articles be proposed to the legislatures of several states as amendments to the Constitution of the United States.

So here's a group of people.

Imagine this.

Two-thirds say

we believe these things should be done, but we have to send them to all of the states to ratify, and they need two-thirds to be able to pass it in their state, and then we will need two-thirds of all the states to agree.

Okay?

Wow, what a process.

And what are they trying to do?

Get themselves a raise?

No.

Give themselves more power?

No.

The exact opposite.

Here's what they say.

The amendments to the Constitution of the United States, all or any of which articles, when ratified by three-fourths of the legislatures, to be valid in all intents and purposes as part of said Constitution.

Articles in addition to and amendment of the Constitution of the United States of America proposed by Congress and ratified by the legislature of several states.

They're saying here

that

after the convention, a number of states having at the time adopted the Constitution, this is in the little preamble here, expressed a desire in order to prevent misconstruction or abuse of its power.

So the guys in the government said, I'm afraid people are going to abuse the power and misunderstand the Constitution.

So,

quote, further declaratory and restrictive clauses should be added.

And as extending the ground of public confidence in the government will best ensure

the benefit ends of the institution.

So they're saying, look,

nobody trusts the government right now.

Does that sound familiar?

Nobody trusts the government right now.

So

we want to pass several amendments here that will protect the rights and make sure that the hands are tied of the federal government.

They're saying these are restrictive clauses.

And by telling the people, we will never do these things, confidence will be gained.

I contend our

problem is we're no longer unified on these 10 articles.

We no longer care about them.

We no longer learn them, teach them, know them.

So here's Article 1.

Amendment number one, Congress shall make no law

respecting an establishment of religion.

I contend we are violating that right now

because what what we are celebrating is a religion.

It has a cult following.

It has nothing to do with science or even common sense.

It has a tribunal that will excommunicate you from society if you don't get involved.

It has rituals.

It has laws that you just must accept on faith.

I know that's pushing it, but I think they're doing that.

They are also breaking the second part of the First Amendment, prohibiting the free exercise of religion.

They did that during COVID.

Abridging the freedom of speech or of the press and the right of the people to peacefully assemble and to petition the government for a redress of grievances.

They don't want you standing up.

They don't want you standing up.

They'll do everything they can to make sure you sit down.

If you're a constitutionalist, enough of this national Christian nationalist stuff.

Enough of that.

Don't dismiss it.

It's real.

It's very, very small, but it's real.

So don't call yourself a Christian nationalist.

Don't allow yourself to fall into that trap.

No, you're not.

You might be a Christian, but you are also a constitutionalist.

You believe in the Constitution of the United States and the Articles of the Constitution, of the Bill of Rights.

You believe in all of that stuff.

That's all you want.

Article 2:

a well-regulated militia being necessary to the security of a free state, the right of the people to keep and bear arms shall not be infringed.

That's the one that everybody will look to on this particular

new center from the Department of Justice.

a well-regulated militia.

Would that make sense?

Would it make sense that

the people couldn't have guns

and the federal government would have a huge army?

No.

In fact, we never had a standing army.

We were the soldiers.

We would be called up to arms.

So you'd have your own arms.

And then when there was war, you'd be called up in a militia.

Okay?

But you had the right to protect yourself with a gun as well.

Not I was for fishing or hunting or one of those things.

No, it wasn't.

No, it wasn't.

Article 3, I think we can skip over.

No, well, no, actually not.

No soldier shall in time of peace be quartered in any house without the consent of the owner, nor in time of war, but in a manner to be prescribed by law.

So Article 3, I think you could make the case, I don't think you'd win, but you could make the case that our government is quartered soldiers are quartered in our house because they are in a public-private partnership with Amazon and everybody else they are they're gaining access to our papers to our letters to our emails to our phone calls that's what the government was doing that made this article important.

The king would say, you know what, find out what those guys are doing over there.

And you know what?

Just go into their house.

You live there.

I'm going to quarter you in their house so you can spy on them.

Well,

it's just in a different way, but that's what's happening.

Fourth Amendment, the right of people to be secure in their persons.

Do you feel secure in your person?

Houses, paper, effects against all unreasonable search and seizures shall not be violated.

It's violated all the time.

We've talked about this many times.

How many people have been driving down the street and they had money in their car and they were going to go buy another car and they were going to buy it in cash and they're stopped.

Their cash is taken.

No due process.

I think you're a drug lord.

That, wait, what?

No warrants shall issue but upon probable cause.

This is a general warrant.

This is why they were, this is why this is in here.

In Article 4,

no warrants shall issue, but upon probable cause.

General warrants used to be, you know, there's something going on with that guy.

Go find out.

And they could search for anything.

Anywhere.

No, no general warrants.

You have to know

and tell the judge, I'm going in for this document or this particular item, and I believe it's here.

Great.

So the judge will say, you can go there in their house and look for it, but no general warrants.

You can't go in and just try to find something.

No person shall be held to answer for capital, otherwise infamous crime unless

the presentment or indictment of a grand jury, except in cases arriving in the land or naval forces or in the militia, when in actual service in time of war or public danger.

Nor shall any person be subject subject to the same offense twice to be put in jeopardy of life or limb, nor shall he be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property without due process of law.

Nor shall private property be taken for public use without just compensation.

Those are being violated, but in particular with this new center where they can take, come into your house and take your guns without due process.

Clear violation of the Bill of Rights.

Clear.

So you got three of them now that have been broken just for this one law.

Don't tell me you love democracy.

Don't tell me you love freedom.

Don't tell me you're trying to save the Republic and you love the Constitution.

If you're violating this many and we're only halfway through,

you are in direct violation of the Bill of Rights.

Article 6, in all criminal prosecutions, the accused shall enjoy the right to a speedy and public trial.

Has that happened with those who are still waiting for trial for January 6?

How is it

they have to wait so long?

But Donald Trump has to be done by this summer.

Why is that?

Are all men created equal?

Are we looking at the people of January 6th with the same blind justice eyes as Donald Trump?

No, of course we're not.

Violation of the Constitution by an impartial jury of the state and district wherein the crime shall have been committed.

Impartant

jury.

If you can't get an impartial jury, what do you do?

You can't get an impartial jury.

You ask for a change of venue where you can get an impartial jury you don't have an impartial jury court

pool in Washington DC you don't

and to be informed of the nature and cause of the accusation to be confronted with the witnesses against him to have compulsory process for obtaining witnesses in his favor and have the assistance of counsel for his defense in this new center that they announced, you don't get the due process.

You don't get to face the witness.

You don't know the cause of accusation.

You have nothing on your side.

I was 500 pounds.

The doctor,

you know,

said I was having a problem breathing.

Doctor says, well, how bad was it?

I said, well, that's the closest I ever felt like committing suicide.

And he asked me, well, how would you do it?

And that activated a smart alleg gene in me that started rattling off 101 ways to kill yourself.

So he put me up for evaluation.

I went into the evaluation.

The judge said, turn me loose.

Nothing wrong with you.

Said, you know,

you're fine.

And they say, and I've got medical records.

It's open.

I'd

put it out for everybody.

Anyway, then

I'll go to buy a gun, and the state is saying I am a mental defective because I had an evaluation.

I gave them all the court documents and stuff.

I said, look,

the judge says right here, nothing wrong with you you're turned loose but they because they have this new thing going now they're saying well we we just don't feel comfortable with it so uh it doesn't matter what the judge says we're we have you listed as a mental defective and there's no way yeah so so david uh i don't know about your personal situation at all but you are right for anybody who has uh said this stuff is coming it is now not coming it is here and i worry about the people, especially our soldiers, who have had any PTSD.

If you signed a document with PTSD, I think you're going to be first on the list.

Anybody who has had problems with depression or suicide, they're going to be deemed a danger to themselves or society.

You watch.

You were a prophet on this one.

Okay, back in October, back in October, November, I did stick a pistol to my head.

First, it was a six-shooter, then in November, I stick it.

So after that, I had to go get help.

And I went to the VA,

and I talked to the VA about it and I was very upfront and truthful with them.

And then that Sunday, I went to church and I got on my knees and begged for help

because I wanted out of that church because I've not been in church for 40 years.

And so what happened, Steve?

Well,

there was a delay.

I'm sorry.

When I was in that church, Glenn, I wanted out of there so bad.

So bad I wanted to get out because this is not where I belong.

This is not where I belong.

And when mass was over, I went to the front and I got on my knees and begged for mercy.

And, you know, and I could just feel the pressure being released from these demons.

These demons were losing.

And since November, I've talked to the VA and told them, Yes, I had these thoughts.

And they quickly, what they do, they red flag your record.

They red flag you.

And now I hear over the weekend, you know the Department of Justice is going to go to the VA and look for veterans.

My advice to veterans, watch what you say to the VA.

If you've got a problem, go to your church.

This is going to stop people who need help or need medication or need just to talk to somebody.

It's going to scare them off.

They're not going to do it because if there's a record of it, then they could have their guns taken.

And, you know, I know that doesn't sound like a big thing to some people, but that is a big thing.

As somebody who enjoys shooting,

enjoys it as a sport.

That's one thing.

But also as somebody who, I mean, I hear these rookies on TV all the time saying, oh, hey, my family, I feel, I got a phone call said, you know, you're, I'm going to, you're going to be in trouble because I've got a jump rope and I'm going to trip you.

You're like, really, really?

You see the threats and the my children growing up in a house with a monitor on the refrigerator and in the kitchen where they were every day going through, if you see this person, tell one of the security people.

If you see this person, make sure sure you run the other direction so don't tell me about you know death threats i get them all the time

and i am i will protect myself

and i will protect my family

and this is a way for people to take away my right to a gun if

If they can find something that I've done wrong, or they can find one of my kids in in the house who, you know, was depressed and wanted to kill themselves.

Well, is it safe?

Yes, all my guns are locked up.

But they're going to do this, and this will prevent people from going to get help.

Again, the medical people, and what a surprise, it's coming from Johns Hopkins University, the first German progressive university and hospital in the country.

That's all a progressive nightmare.

What a surprise they're the ones doing it because I seem to remember them being the ones also that were saying, you got to take, you got to take the COVID vaccine.

Otherwise, you're a danger to society.

And what did that do?

You know, we wouldn't have a problem with vaccines.

At least the vast majority of people would not have a problem with vaccines if you weren't forcing people to take it when it was absolutely untested.

Now you made such a big deal of six feet distance, lock your kids up in the house, don't let them go outside, wear a mask, wear a mask, wear a mask.

You got to take the vaccine or you're a danger to society.

Nobody's listening to the medical community anymore.

And whose fault is that?

Yours.

Yours.

Americans especially push back on authoritarianism.

We inherently don't trust people when they say, oh no, trust me,

you have to do this.

No, I don't have to.

But you've pushed this.

And now you're going to hurt yourself even more.

If you use any medical file,

you'll destroy.

the medical industry, which is, you know, again, a win-win for those who are trying to destroy America, destroy the credibility of your medical workers.

You'll destroy it.

And if doctors and nurses don't stand up and say, hey,

this is private and confidential, no,

I'm not turning anybody in.

This is why we've always trusted people in America.

We've always been so open-minded and trustworthy.

People come from over in Europe and they say, man, Americans are just so open and

honest, and they'll just invite you to their house and whatever.

Yeah, you know why?

We've never had our state or our neighbors turn each other in.

We've never had a state that said, hey, you know, something's going on.

You should check your neighbor's mailbox.

I'm sorry.

We only had it for a couple of years.

And then it was immediately stopped.

And that was under Woodrow Wilson.

He had 600,000 people working for his administration.

They were called minutemen, three minutemen, because they could give an impromptu speech in three minutes.

And

he had them spy on their neighbors,

listen on the party lines back in the days, go through their mail.

It's illegal.

Didn't matter.

They were turning people in.

I think he's against the war.

You can't go down this road and come back unscathed.

You can't.

It just has to be stopped.

A few things happened this weekend that are kind of of note.

One, Russia, they're blaming us and Ukraine for a horrific terrorist attack.

God help us if we were involved, but I don't think we were.

But does that matter?

We're going to look at the war situation this hour.

Also, more on the National Extreme Risk Protection Order Resource Center that the Department of Justice announced over the weekend.

You know, surprisingly, right after they passed that $1.2 trillion budget.

It's weird.

It's almost like they didn't want that to slow anything down.

And we also have Andy McCarthy on.

We're going to start with him because today's the day that New York can start to seize Donald Trump's assets.

Can they?

What can't they do?

How long does this process take?

What should happen?

The guy that I know has many of those answers is Andy McCarthy.

Andy was a former U.S.

attorney for the Southern District of New York.

So he knows how the game is played up there and knows where the bodies are buried and most importantly knows the law.

Seems like we've been doing this for a long time, Andy.

My gosh.

So

now we're dealing with a couple of things that I never thought we'd have to deal with, and that is

all hands on deck, everything we can do to destroy a candidate or a president, they're doing.

And today they can take the assets away from Donald Trump.

At least that's what they're going to try to do.

Are they going to seize the assets of Donald Trump?

No, I don't think they're close to doing that yet, Glenn.

Today is the day that Letitia James, who's the Attorney General in New York, said that she would start the process of trying to seize assets in connection with this preposterous $454 million judgment.

I should say $454 million in counting because the interest is accruing at $112,000 a day.

Oh, my gosh.

So, Andy, didn't she file something over the weekend about his Westchester golf course?

Yeah, well, she is taking preparatory steps, Glenn, that you would have to take if you were about to try to to attach people's property in pursuance of a judgment.

But I don't think she's going to jump yet because they went to the Trump people went to the appellate division, which is in the in New York the New York court system, the nomenclature is ridiculous.

But the appellate division is like the federal court equivalent of the circuit courts.

It's like the intermediate appellate court.

And he's asked them to stay the enforcement of the judgment while he's appealing and asked them to take a modest size bond or no bond at all rather than the usual practice, which is to post a bond for the full amount of the judgment, because that bond would be ruinously expensive to try to arrange.

We haven't heard yet from the appellate division.

So I think

it would be very presumptuous and, from her standpoint, bad for James to try to do anything before the court has

acted.

Does he have a shot at a fair hearing at the appellate court?

Yeah, I think so.

You know, at the beginning of the civil trial, the appellate court knocked out of

a number of things that Judge Engeron wanted to do to Trump, including taking away his business certificates and seizing things that weren't even or paralyzing components of Trump's conglomerate that weren't even in the case.

So they gave him a pretty fair hearing at the beginning.

And

even though they didn't so far give him the stay he's asking for, they did throw out, at least temporarily, Engeron's penalties that included putting Trump out of business in New York and denying him the ability to work with financial institutions to get loans.

So I think he's going to get a fair,

this is a low bar, but I think he's going to get a fairer hearing from the appellate division than he got from Edgaron.

If this actually goes through,

how is New York going to survive just the business people who say, well, I don't want to be on the wrong side of New York State.

They can change the rules or work it any way they want.

I got to get my money out of here.

Yeah, I couldn't agree with that more.

And when I've made that point, Glenn, what people push back on is this kind of thing, which

even by itself, if you just took it at face value, is disturbing, which is that this is like that Trump is sui generous, that this is only law for Trump and it doesn't apply right now.

Now,

first of all, that would be, if that's true, that in and of itself is a scandalous measure of not only what's happened to the law, but what's happened to the culture.

But I think the thing with the left, in my experience, is once they achieve something that was

theretofore not done before, then nothing is truly generous anymore.

And

if they could do it to Trump, Trump's not the only enemy that the left has.

They don't like fossil fuel companies.

They don't like gun companies.

They don't like companies in general.

So

once they do it to him and they've set the precedent, the thought that this won't be applied to anyone else is crazy.

And that's why I think every big big dollar business in New York is asking itself, do we really need to be in New York?

That is so going to hurt New York.

And I just don't,

I don't, I can't figure out their end game.

I really, you know, when you look at their end game, anything sane is off the table.

I mean,

I don't know how this one ends.

Yeah, I think New York is kind of a microcosm of what's happened to the Democratic Party in general.

Like, I don't think most rank and file Democrats across the country, like ordinary people who identify as Democrats, I don't think they're on board with a lot of the stuff that

Biden has done and a lot of the woke stuff.

But I think the people who are on board with that are the most flush with money, the loudest, the most obnoxious, and the ones that the decision makers fear.

So what's happened in New York is, like, for example, Tish James, in a very kind of Soviet-style campaign, actually said, elect me and I will use the power of my office to go after Trump.

Right.

She won in a landslide.

In the 1990s, when I was a young lawyer in New York,

if a person wanted to get elected to a state legal position and campaign like that, that would be disqualifying.

But today, she wins in a landslide.

So I think that says a lot more about what's happened to New York than what's happened to the law.

So tell me your thoughts on the new DOJ's arm, the National Extreme Resc Protection Order Resource Center.

This is terrifying.

And how did they get it all on a door?

That's what I want to know.

I know.

Well, they're calling it...

In the spookiest thing, weren't the Russians, when they were doing spy operations, wasn't it called the center that gave all the instructions?

Oh, you may be right about that.

I don't know that history.

And that's what they're calling this.

They're calling it the center.

Yeah, well, you know, look,

at the Justice Department, speaking of microcosms, you know, the Justice Department is like the microcosm of the

Biden administration in the sense that, you know, it's run by this

elderly, seemingly well-meaning guy

in Merrick Barland, who was kind of advertised as the moderate who was going to keep the crazies at bay.

But

he's a weak person, and the crazies have been running the Justice Department since he took over.

And they have some really radical people.

Glenn, this is like our constant conversation for 20 years, right?

But

they have really radical people running the Justice Department in very high-ranking positions in the civil rights division and in anything that they have to do on the national security side.

So, you know, and right now Congress is very dysfunctional, and that's worth noting because we've seen time and again that the courts are simply not capable, including the FISA court, of monitoring stuff that the Justice Department brings them.

So if Congress doesn't do a good job of oversight, then you've got the lunatics running the place.

Yeah, there is no oversight.

Andy, do you see any of this changing internally?

Do you hear from FBI agents or people at the DOJ

or anybody starting to say, okay,

okay, this just, I got to stand up here pretty soon?

No, I don't, you know,

I was kind of hopeful when we had those whistleblowers come forward in the Biden investigation that maybe we would shake some loose from the FBI as well, but it really hasn't happened.

And I think, you know, a lot of people are are getting out.

A lot of people are just trying to keep their head down and hope that a new regime comes in in November and

some of these guys are washed out.

But it just seems to me that

most of the Biden Justice Department is just the Obama Justice Department four years down the road.

So these people are just more senior and more powerful and more networked.

And I think unless Congress comes in and completely restructures the FBI and actually starts slashing their budget so that they can't, the only language they understand is slashing their budget.

And no one, you know, I think, I think when Trump started, the, you know, Trump, who wasn't crazy about the FBI, right?

I think when he started, their budget was something like in the low 30 billions.

And I read something recently that it's now over 40 billion.

So it just gets bigger.

You know, everybody complains about them, but they just give them more resources to do more of this stuff.

Yeah.

Andy, thank you so much for filling us in and giving us some perspective on Donald Trump.

Just a guess as a human being, if they start taking away his stuff, I think that helps him at the polls.

I do too.

I think it's,

yeah, I've always thought that, you know, if you're talking about accusations and what's in a complaint and what's in an indictment and all that stuff, I think a lot of that washes over people and becomes kind of abstract.

But when you start to like actually take his stuff,

that's going to hit people in a different way than just like the thrum of conversation about, well, he overvalued this and

they

got a favorable interest rate on.

This is like when she shows up with a chain and puts a lock on Trump Tower,

that's a thing now.

That's going to hit people in a much different way.

I would have thought that, though, of

what's her name down in Georgia when she perjured herself.

So,

I mean, she wanted to answer those questions and answer them with lies.

And she didn't seem to pay any penalty and nobody seems to care.

I don't know how we trust, you know, an AG

or a prosecutor when they can lie to two different courts and get away with it.

Yeah, but, you know, the legal system's kind of a lagging indicator that way.

I mean, I hear people say what you just said, I've always heard said about Hillary Clinton.

Like, she never gets held accountable, nothing ever happens.

And my reaction to that is always, do you remember the Hillary Clinton presidency?

There wasn't one, right?

And it's because I think the public,

you know, where the public is on this stuff is very different from what you see from like the elites who run the you know, the legal profession.

I actually think

Fannie Willis is badly wounded by that judge's opinion and that the appellate court down there, when they get their hands on it, may actually boot her off the case.

For me, just as a legal matter, if I was running Trump's defense, the one expenditure I would make is I would make sure there was a limo at Fannie's house every day to make sure she gets to work because I think she's the best thing he's got going for her.

That's how close we are.

We have some breaking news.

It looks like the judge,

the

panel of judges, has actually done Donald Trump a little bit of a favor here.

I would say it's

a favor.

I don't know if it's the right way of stating it, but a massive decrease in the amount of money he needed to come up with.

If you remember, it was $464 million.

He claimed he could not come up with that amount for a bond, went to court, tried to overturn that, and they have reduced it significantly to $175 million.

So over a 60% reduction in that number.

Now, of course, $175 million, to my taste, is still excessive and ridiculous for what's gone on here.

Completely excessive and ridiculous.

Nothing ever like this.

No.

And

as we've noted many, many times, I did a whole show on this on Studios America, where you go through the ways this rule has been used historically, and there are no parallels at all to what has happened with Donald Trump.

It is quite clearly and quite obviously a political persecution, whether you like Trump or not.

And so, but this is a big difference because he can probably come up with $175 million instead of the $464.

So a huge deal, a massive victory for Donald Trump in this case.

And I'm curious to see, because Letitia James has gone through the

ritual of posting over and over again the amount owed by Donald Trump, like bragging about it because it keeps going up as Andy McCarthy mentioned, it was $100 and some odd thousand dollars a day.

And she just keeps mentioning, I wonder if she'll continue that process now that it's gone down by over 60%.

We will see

because she's been bragging about this for

weeks and weeks and now takes a massive hit.

And I think a blatantly obvious one, right?

Like I think anyone who looks at this fairly can tell

this was ridiculous from the beginning and now a big slap in the face for this original ruling.

I'm wondering if he could come up with the 171.

I would think so.

You know, he claimed in one filing to have $400 million in cash.

Now, he had to come up with a bond for the Eugene Carroll thing, which was 90-something million, which would suck some of that out.

Whether he's, you know, he could do it probably all himself.

However, when you have that sort of money,

you can also when you have that sort of cash laying around, you can usually get someone to loan you that with the cash as collateral very easily.

So

regardless of the process he goes through, you'd think he'd be able to get this.

Again,

if you can find a bank.

Yeah, although, you know, this

I'm of the view, and I've mentioned this before, this is just my own speculation, is that Donald Trump could have come up with the $464 million.

He correctly argues that that is completely unfair.

And I think, you know, given time, he could come up with that sort of money.

But why not play this out?

Why not push this as far as you can?

It's going to take a long time until they actually start seizing property, as Andy laid out a little bit earlier.

And, you know, why not use that time to the best of your ability to fight this off?

Because I think he's very likely to win.

I think he's very likely to win in an appeal or at least have this reduced to, you know, maybe a dollar fine or a $10,000 fine or something that would be somewhat aligned with reality.

I think eventually he probably wins this.

So the longer he can play this out without having to give up resources, the better.

you know you the one thing that is

good from all of this i try to look at the bright side on everything as much as i can and i can usually never find it because that bright side has been snuffed out long ago in my life anyway um

wow i

the

the uh the bright side on this in some ways is i don't think people really understood what it was like back in the jim crow days i don't think white people really understood what it was like where you just, there's not a chance you're getting a fair trial.

Not a chance.

And kids don't trust the police.

We don't understand that.

And now this injustice is being served on so many Americans from the FBI to the Justice Department to the to the court system in Donald Trump's case.

And it does give you a view on how important justice is, the kind of justice that many of us have taken for granted our whole lives.

You know, that's all right.

The courts will figure it out.

And yeah,

how many times have we said lately that the courts are the only thing standing between us and chaos?

They've been probably the

shining

light.

When it comes to justice lately, as we've seen in the Supreme Court multiple times,

to think of where this is going and how close we are to that precipice is really, we really are on the precipice of disaster when it comes to this.

I just, I am glad to see, though, that at least

there's something, like even in these cases, even with someone like Donald Trump, who they're obviously trying to take out, the system does have a way of

coming through at the end.

And I think, you know, might be, it might go, I need to go all the way to the Supreme Court, but it does seem to play out the right way a lot of times.

And I don't know, maybe the system holds together.

It doesn't feel like it's going to a lot, but it has so far.

Speaking about not being able to hold together, that would be the GOP Congress.

Republican Mike Gallagher of Wisconsin announced last month he's not going to seek re-election.

He's now announced that he plans to leave office next month.

What a dirtbag.

What are you doing?

What are you doing?

You're leaving, and he's not just leaving next month.

He has scheduled his last day in Congress to be a week after the deadline to be replaced.

So he's just vacating the seat.

They can't replace him after a certain date

before an election.

They just vacate the seat.

So he's taking, not only is he leaving, which good, don't let the door hit you or the good Lord split split you.

I mean, unless it just knocks you down to the floor.

I'm not going to miss Mike Gallagher.

But why are all these guys on the Republicans, on the Republican side, just jumping ship here in the last few months?

You can't wait until the election?

Really?

You can't do that.

You're just going to reduce the margin for us.

By the way, he's also going to Palantir, which might explain his vote for

not

impeaching Mallorca, seeing that Palantir has such huge business with the Department of Homeland Security.

Maybe that played a role in, because he had to have known he was going to Palantir at that time.

It's possible.

And I think, look, you want to leave Congress?

And I have no problem with people leaving Congress.

You just think that if you have a concern for the country and you're worried about,

and as I assume he is, worried about what the Democrats could do with unfettered power, they are very, very close to getting it.

I mean, who knows what happens?

I mean, you're telling me the Republicans can't screw this one up.

They're really good at screwing things up.

If they are able to just pull a couple of votes over to get this thing to the House floor, and it could definitely get through the Senate.

I don't think there's any question about that, even with a potential filibuster.

you know, this does help that case.

And

you wonder if that's part of his calculus here.

You know, look, if you care about protecting against

a democratic rule with no real way to stop anything that they pass, I mean, this is not the time to leave.

I'm sorry if it inconveniences you for a few months, but like safe until the election.

If you care about the country enough to say, hey, look, the southern border is out of control, the last thing you want to do is...

is give the possibility of full control of the house over to the people who are fine with them being open the borders.

I mean, what are you doing?

I think this is really dishonorable i'd love to hear him comment on it we should invite him on the show i doubt he'll come but uh i find it very dishonorable and i maybe it's because i don't know something that he knows you know maybe his wife has cancer or whatever and okay

You're not allowed to make jokes anymore because you might find out after the fact that the person has cancer and therefore that makes you a retroactive bad person.

I I don't want to judge somebody without knowing he might have some really good reason.

I don't know what it is.

But if it's just because he wants to go to work for Palantir, what the hell are you doing, man?

It's not a good time for that.

I'm not fired up on that because of you and your, I think, appropriate disclaimer there.

Like when you don't know all the facts, it's good to say, hey, like maybe there's something I don't know.

To acknowledge that maybe you don't have all of the facts.

And, you know, I think that's a smart thing to do.

I was kind of just ranting on that, on the Kate Middleton thing.

Not because I care really about, you know, anything about the Royals, but it's like

everyone is in this weird state where they're saying, like, I can't believe these bad people who made jokes about Kate Middleton.

And now they found out that she has cancer and now they should feel terrible about themselves.

Actually, like, I don't think that's the right way to look at it at all.

You're totally free to make fun of public figures if you later find out that she has cancer and that's the reason why, you feel really bad about that because you care about another human being.

But that doesn't mean you are the worst person in the world.

You didn't know she had cancer.

So the joke isn't applied to the cancer lover.

Hang on now.

In January, I underwent major dogma surgery in London.

And at the time, it was thought that my condition was non-cancerous.

The surgery was successful.

However, tests after the operation found cancer had been present.

My medical team therefore advised that I should undergo a course of preventative chemotherapy, and I'm now in the early stages of that treatment.

This, of course, came as a huge shock, and William and I have been doing everything we can to process and manage this privately for the sake of our young family.

And we'd just like to say that everyone who made a joke of me, you should all burn in hell.

You're just bad, bad people.
